ORDER granting in part and denying in part 11 Motion to Dismiss as follows: Defendants motion to dismiss is denied as to Count One; Defendants motion to dismiss is granted as to Counts Two through Six; Defendants motion to dismiss is granted as to Plaintiffs claim for punitive damages. IT IS FURTHER ORDERED that Plaintiffs have 30 days from the date of this Order to file an amended complaint to cure the deficiencies identified herein. If Plaintiffs fail to file an amended complaint within 30 days, the Clerk of the Court shall, without further Court order, dismiss with prejudice Plaintiffs claims in Counts Two through Six, as well as Plaintiffs claim for punitive damages.
