ORDER - Plaintiff's Motion to Set Aside the Judgment and Reconsider (Doc. 18) is granted. The Order dated November 18, 2010 (Doc. 16) is vacated. Within 14 days of the filing of this Order, Plaintiff must either file a Notice that the Court has correctly characterized his claim or move to amend the complaint, attaching to the motion a copy of the proposed amended complaint, as set forth in this Order. Plaintiff's Motion for Class Certification (Doc. 22) is denied, and his request for a ppointment of counsel (Doc. 22) is also denied. This matter is referred to Magistrate Judge Jay R. Irwin pursuant to Rules 72.1 and72.2 of the Local Rules of Civil Procedure for all pretrial proceedings as authorized under 28 U.S.C. § 636(b)(1). Signed by Judge G Murray Snow on 2/9/11. (KMG)

ORDER the reference to the Magistrate Judge is withdrawn as to Defendant's Motion to Dismiss and granting 10 Defendant's Motion to Dismiss, the claim against Meiner is dismissed without prejudice for failure to exhaust administrative remedies, and Meiner is dismissed. ORDER (Service Packet) Pla's Application to Proceed In Forma Pauperis (Doc. 3) is granted. As required by the accompanying Order to the appropriate government agency, Pla must pay the $350.00 filing fee and is assessed an initial partial fi ling fee of $3.33. Dfts Williamson, Samberg, Griego, and Estrada are dismissed without prejudice. Dft Meiner must answer the Complaint. The Clerk of Court must send Pla a service packet including the Complaint (Doc. 1), this Order, and both summ ons and request for waiver forms for Dft Meiner. Pla must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. This matter is referred to Magistrate Judge Jay R.
