Plaintiff's Motion for Class Certification (Doc. 22) is denied, and his request for a ppointment of counsel (Doc. 22) is also denied. This matter is referred to Magistrate Judge Jay R. November 18, 2010 Opinion or Order Filing 16 ORDER the reference to the Magistrate Judge is withdrawn as to Defendant's Motion to Dismiss and granting 10 Defendant's Motion to Dismiss, the claim against Meiner is dismissed without prejudice for failure to exhaust administrative remedies, and Meiner is dismissed.
