Plaintiff's allegations in Count One that (1) the Tempe Defendants violated Plaintiff's co nstitutional rights under the Fourteenth Amendment, (2) the City maintains a custom, policy, practice and/or procedure of deliberate indifference to medical care of individuals, and (3) the City inadequately supervised and trained the Tempe Defendant s are hereby dismissed without prejudice. ORDER that Plaintiff must file an Amended Complaint on or before 1/28/11. If Plaintiff fails to comply, the Clerk of Court is hereby directed to remand this action back to the Maricopa County Superior Court. Signed by Magistrate Judge Lawrence O Anderson on 1/18/11.(TLJ)
