ORDER - IT IS ORDERED Plaintiff's "First Amended Notice Of Motion For Summary Judgement In Lieu Of Complaint" (Doc. 5 ) is denied as moot. This action is dismissed without prejudice pursuant to Rule 41(b) of the Federal Rules of Civil Procedure for failure to comply with the Court's Order filed January 25, 2011 (Doc. 4 ). The Clerk of Court must enter judgment accordingly and close this case. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3) and Federal Rules of Appellate Procedure 24(a)(3)(A), that any appeal of this decision would not be taken in good faith.
