ORDER that Abengoa's Motion to Dismiss and Compel Arbitration (Doc. 6) is GRANTED IN PART AND DENIED IN PART. The Motion is granted in that Tierra is ordered to submit to arbitration consistent with the terms of Section 16 of the Agreement and t his Order. The Motion is denied in that all of Tierra's claims against Abengoa are STAYED pending resolution of that arbitration. FURTHER ORDERED that Tierra and Abengoa shall file a joint status report informing the Court of the progress of arbitration on or before September 7, 2011 and thereafter every 90 days.
