ORDER The reference to the Magistrate Judge is withdrawn as to Defendant's Motion to Dismiss (Doc. 18). Defendant's Motion to Dismiss (Doc. 18 ) is granted; the Complaint is dismissed without prejudice for failure to exhaust; in the altern ative, it is dismissed without prejudice pursuant to Local Rule of Civil Procedure 7.2(i). The Clerk of Court must enter judgment accordingly.
