ORDER granting 56 parties' Stipulation of Settlement and Parties' Joint Motion for Court Approval. The parties' Settlement Agreement is hereby APPROVED in its entirety. Factor Sales shall promptly distribute all settlement checks as agreed in the parties' Settlement Agreement. Except for Plaintiffs' claim for an award of their attorneys' fees, court costs, and other litigation expenses authorized by law, all claims in this action are hereby dismissed with pr ejudice. The Clerk is kindly directed to enter a final stipulated Judgment in favor of Plaintiffs and against Defendants consistent with the parties' Settlement Agreement. IT IS FURTHER ORDERED certifying a class action in this matter and permitting the named Plaintiffs and the putative class of similarly situated individuals to proceed as a class action pursuant to Federal Rule of Civil Procedure Rule 23 with respect to the state law claims.
