ORDER granting Ms. Miles's Renewed Motion Regarding Substitution of Party (Doc. 176 ). FURTHER ORDERED substituting Elaine Miles as Plaintiff for the decedent, Lawrence Wade Miles, in this matter. FURTHER ORDERED granting in part and denying in part Defendants' Motion for Judgment on the Pleadings (Doc. 177 ), as follows: Plaintiff' claims for pain, suffering and punitive damages are extinguished; Plaintiff's claim for nominal damages survives for trial. IT IS FURTHER ORDER ED setting this matter for a telephonic status conference on June 1, 2016 at 2:30 p.m. before District Judge John J. Tuchi in Courtroom 505, 401 W. Washington Street, Phoenix, AZ 85003. Counsel who will try the case shall have their calendars availab le and be prepared to discuss the trial schedule, length of trial, and any other issues related to trial of this matter.
