FURTHER ORDERED granting in part and denying in part Defendants' Motion for Judgment on the Pleadings (Doc. 177 ), as follows: Plaintiff' claims for pain, suffering and punitive damages are extinguished; Plaintiff's claim for nominal damages survives for trial.
