Filing 16 ORDER ADOPTING REPORT AND RECOMMENDATION, the Court hereby accepts the 14 Report and Recommendation; the Petition for Habeas Corpus is denied and this action is dismissed with prejudice; a Certificate of Appealability and leave to proceed in forma pauperis on appeal are denied because Mr Huggins has not made a substantial showing of the denial of a constitutional right as required by 28 U.S.C. § 2253(c)(2)6 and, given the clear procedural bar to Mr Huggins' petition, any appeal would not be taken in good faith; the Clerk shall enter a final judgment accordingly.
