ORDER ACCEPTING REPORT AND RECOMMENDATION 14 - Petitioner's Petition for Writ of Habeas Corpus (Doc. 1 ) is denied and dismissed with prejudice. The Clerk of Court shall terminate this action. Pursuant to Rule 11(a) of the Rules Governing Se ction 2254 Cases, in the event Petitioner files an appeal, the Court declines to issue a certificate of appealability because reasonable jurists would not find the Court's procedural ruling debatable. REPORT AND RECOMMENDATION recommending that 1 Petition for Writ of Habeas Corpus (State/2254) be denied and dismissed. IT IS FURTHER RECOMMENDED that a Certificate of Appealability and leave to proceed in forma pauperis on appeal be DENIED becaus e Petitioner has not made a substantial showing of the denial of a constitutional right and because the dismissal of the Petition is justified by a plain procedural bar and jurists of reason would not find the procedural ruling debatable.
