ORDER. The Court met with the parties this morning regarding their dispute about the location of the deposition of Mr. Hernandez, the person who assigned his rights against Defendant to the Plaintiff. The deposition shall be held in Arizona, with Mr. Hernandez's reasonable travel expenses to be born by Plaintiff. If Mr. Hernandez refuses to come to Arizona the deposition will be held either in Mexico or by video from Mexico, at the election of the Defendant. Nevertheless, if Defendant elects for a video deposition and Plaintiff's counsel chooses to travel to Mexico for the deposition he or she may do so. In either case, all reasonable expenses for the deposition shall be born by the Plaintiff. If the parties travel to Mexico for the deposition, Plaintiff will pay the reasonable travel and lodging expenses of Defense counsel as well as any expenses incurred in obtaining an appropriate location for the deposition. Similarly if the deposition is by video, Plaintiff will pay the expenses incurred in arranging for the facilities, deliveries and other matters necessary to conducting the deposition.
