Plaintiff must file his certification whether or not expert testimony is required within 14 days. Plaintiff must then disclose his preliminary expert affidavit in accordance with the Court's Scheduling Order and 12-2603(B). Miner must file an Answer within 14 days of this Order. Filing 45 ORDER granting in part and denying in part 29 Rowe's Motion to Dismiss; Plaintiff's negligence claim against Rowe in Count III is dismissed. The motion is otherwise denied. IT IS FURTHER ORDERED granting in part and denying in part 36 Wexford's Motion to Dismiss; Count II against Wexford is dismissed. Count III against Wexford is dismissed as to any reliance on the actions of Rowe, Allred, and Unnamed Clinical Coordinator. Plaintiff's respondeat superior negligence claim based on Miner's conduct remains. Rowe, Allred, and Wexford must file an Answer within 14 days of this Order.
