IT IS FURTHER ORDERED th at Grounds 3, 4, 5, 6, and 7 of the Petition Under 28 U.S.C. § 2254 for a Writ of Habeas Corpus (Doc. 1 ) are DISMISSED. IT IS FURTHER ORDERED that Ground 1 claims of ineffective assistance of counsel related to Count 6 of the indictment, and G round 2 claims of ineffective assistance of counsel related to Count 3 of the indictment, are referred back to the Magistrate Judge for additional proceedings consistent with this Order, including the holding of an evidentiary hearing on Petitione rs claims of actual innocence on Count 3 and Count 6, and any other proceedings as deemed necessary and appropriate. IT IS FURTHER ORDERED that the Magistrate Judge shall appoint counsel to represent Petitioner if he qualifies for such appointment under 18 U.S.C. § 3006A.
