Filing 23 ORDER ACCEPTING AND ADOPTING REPORT AND RECOMMENDATION 18 - IT IS FURTHER ORDERED that the petitioner's Petition Under 28 U.S.C. § 2254 for a Writ of Habeas Corpus by a Person in State Custody is denied and that this action is dismissed with prejudice. IT IS FURTHER ORDERED that a certificate of appealability shall not issue and that the petitioner may not appeal in forma pauperis because the dismissal of the petition is justified by a plain procedural bar and reasonable jurists w ould not find the procedural ruling debatable, and because the petitioner has not made a substantial showing of the denial of a constitutional right.
