August 25, 2017 Opinion or Order Filing 60 ORDER ADOPTING REPORT AND RECOMMENDATION - The Magistrate Judge's Report and Recommendation (Doc. 55 ) is accepted and adopted by the Court. The Petitioner's Objections (Doc. 58 ) are overruled. The Petition for Writ of Habeas Corpus (Doc. 1 ) is denied and this action is dismissed with prejudice. A Certificate of Appealability and leave to proceed in forma pauperis on appeal are denied because the dismissal of the Petition is justified by a plain procedural bar and reasonable jurists would not find the ruling debatable. January 6, 2015 Opinion or Order Filing 14 ORDER That Magistrate Judge Bade's Report and Recommendation (Doc. 13 ) is accepted and adopted by the Court; That the reference to the Magistrate Judge is withdrawn as to Petitioner's Motion for Stay of Habeas Corpus Proceedings (Doc. [11 ]) and the motion is granted; That this action is stayed pending further Order of this Court; That Petitioner must diligently pursue his state remedies; That Petitioner shall file a report no later than February 4, 2015 addressing the status of his p roceedings in state court; That Petitioner must file a new report regarding the status of his state court proceedings every ninety (90) days after the filing of the initial status report; That Petitioner is warned that failure to comply with these in structions will result in the Court vacating the stay and may result in dismissal for failure to comply with Court orders, see Fed. R. Civ. P. 41(b); and That this matter shall remain referred to Magistrate Judge Bridget S.
