ORDER - IT IS THEREFORE ORDERED granting in part and denying in part Plaintiff Donna Noriega's Motion for Partial Summary Judgment (Doc. 42 ). Plaintiff is entitled to summary judgment as to Counts 2 and 3, but not Count 1. The Court will set a pre-trial status conference by separate Order. IT IS FURTHER ORDERED denying Defendants State of Arizona, Cara Christ, and Unknown Christ's Cross-Motion for Summary Judgment (Doc. 44 ). (See document for further details). ORDER granting in part and denying in part 8 Defendants' Motion to Dismiss. Counts I and II survive. The State of Arizona is dismissed from Count III. Defendants shall file an Answer to the Complaint within 14 Days of entry of this Order.
