Filing 93 ORDER: The reference to the Magistrate Judge is withdrawn as to Defendants' Motion for Summary Judgment (Doc. 78 ), and the Motion is granted in part and denied in part. Summary judgment is denied on Counts 5 and 6 only with respect to Plaint iff's conditions-of-confinement claim asserting he was denied hygiene and cleaning supplies, but granted on Plaintiff's claim that he was denied envelopes, paper, and writing utensils. Summary judgment is granted in favor of all Defendant s on all other claims. Within 30 days of this order, the parties shall file five-page memoranda regarding the expected length of trial, whether a jury trial is warranted, and any other facts that will assist the Court in setting a trial date. Defendant Burnett's 38 Motion to Dismiss is granted in part and denied in part as set forth within the order; Plaintiff's remaining claims against Defendant Burnett shall proceed to the merits. Defendants' Fer nandez-Carr and Prince's 24 Motion to Dismiss is denied. Plaintiff shall respond to Defendants' Interrogatories and Requests for Production by February 2, 2018.
