ORDER granting in part and denying in part 140 Plaintiff's Motion for Reconsideration. It is granted as to plaintiffs' battery and medical battery claims involving finger-stick blood draws. It is otherwise denied. Upon reconsideration, p laintiffs' battery and medical battery claims involving fingerstick blood draws are dismissed without prejudice. Plaintiffs are given leave to amend these battery and medical battery claims. Plaintiffs' battery and medical battery claims involving venipuncture blood draws remain dismissed with prejudice.
