ORDER - Defendant CAWCD's 112 motion for summary judgment is granted as to the Community's standing to assert claims against CAWCD in this case, and is otherwise denied. The Community's claims against CAWCD are dismissed for l ack of standing. The Community's 108 motion for summary judgment on CAWCD's counterclaim against it is granted for reasons set forth above. The United States' 107 motion for summary judgment on its claims against CAWCD is gr anted. The Court enters the following declaratory relief against CAWCD: CAWCD is obligated to deliver up to an additional 10,000 acre-feet of water, as authorized by § 2(b) of the 1984 Act, in any year the Secretary of the U.S. Department of th e Interior determines that sufficient surface water is available and sufficient capacity is available in the main project works of the CAP. CAWCD's obligation to deliver water described in § 2(b) of the 1984 Act is not limited to water av ailable from the 136,645 acre feet comprising the permanent allocations to Ak Chin. The phrase "Excess Water" in the 2007 Stipulation does not includewater described in § 2(b) of the 1984 Act.
