The Clerk of Court is directed to enter judgment accordingly, and awa rd damages in the amount of $3,750,000.00, plus post-judgment interests, to Plaintiff, and against Defendant James R. Toadvine, Jr. Defendant Vicki Lynn Toadvine is dismissed, without prejudice, from this action.
