As for Count Seven, the parties may submit an additional brief, not to exceed ten (10) pages, within 21 days of the issuance of this Order addressing whether Defendants are entitled to summary judgment and/or dismissal of Count Seven due to the absence of any Arizona case recognizing a private right of action for damages under Article II, Section 6 of the Arizona Constitution.
