January 27, 2020 Opinion or Order Filing 201 ORDER: The trial in this matter began on January 14, 2020. During the charge conference, the Court rejected a proposed jury instruction, submitted by Plaintiffs, that would have asked the jury to decide whether Defendants had engaged in the spoli ation of certain pieces of evidence and permitted the jury to apply an adverse inference against Defendants if it made such a finding. Plaintiffs' claims for negligent supervision, negligent retention, negligent maintenance, and punitive damages are dismissed with p rejudice pursuant to Plaintiffs' stipulation; 3. Plaintiffs are precluded from asserting any claim at trial premised on a theory of negligent hiring or negligent training; 4. Plaintiffs are precluded from seeking the following two categorie s of damages at trial: (a) any claim for damages based upon Decedent's pain and suffering, and (b) any claim for the Decedent's future wages asserted by Mother or Wife as part of a wrongful death action; and 5.
