Filing 10 ORDER: The Motion for Reconsideration #9 is granted. The parties in this case have requested an extension of Defendant's time to answer the complaint. The Court concludes that the parties have shown good cause, and will grant a one-time extension for Defendant to respond to the complaint. Because the effectiveness of the MIDP depends in part on early disclosures, the Court will not grant additional extensions. Thus, the parties' obligations to produce the information called for in the MIDP will be triggered by Defendant's response to the complaint after the extension. The parties should be aware that the filing of a motion to dismiss under Rule 12(b)(6) will not postpone the time for compliance with the MIDP. The General Order provides that compliance may be deferred only for motions to dismiss based on lack of subject-matter jurisdiction, lack of personal jurisdiction, sovereign immunity, or absolute or qualified immunity of a public official. IT IS FURTHER ORDERED granting an extension of time for Defendant PVH Retail Stores LLC to respond to Plaintiffs Complaint to November 2, 2018. No further extensions will be granted.
