ORDER - Petitioner's Letters (Docs. #4 , #5 ) are construed as Notices of Dismissal pursuant to Rule 41(a)(1)(A) of the Federal Rules of Civil Procedure. This action is dismissed without prejudice and the Clerk shall enter judgment accordingly and close this case. The Petition (Doc. #1 ) and Application to Proceed (Doc. #2 ) are denied as moot. The Clerk shall send to Petitioner a copy of the Petition (Doc. #1 ). Pursuant to Rule 11(a) of the Rules Governing Section 2255 Cases, in the event Petitioner files an appeal, the Court declines to issue a certificate of appealability because reasonable jurists would not find the Courts procedural ruling debatable.
