Filing 6 CLERK'S JUDGMENT - IT IS ORDERED AND ADJUDGED that pursuant to the Court's order filed January 10, 2019, Plaintiff to take nothing, and the complaint and action are dismissed without prejudice. This dismissal may count as a "strike" under 28 U.S.C. 1915(g). (MSA) |
Filing 5 ORDER - The #1 Complaint is dismissed without prejudice as duplicative of Wise v. United States Department of Justice, et al., No. CV-18-03424-PHX-JAT (JZB) and the Clerk of Court must enter judgment accordingly. Plaintiff's #2 Application to Proceed In Forma Pauperis is denied as moot. The Clerk of Court must make an entry on the docket stating that the dismissal may count as a "strike" under 28 U.S.C. 1915(g). The docket shall reflect that the Court, pursuant to 28 U.S.C. 1915(a)(3) and Federal Rules of Appellate Procedure 24(a)(3)(A), has considered whether an appeal of this decision would be taken in good faith and certifies that an appeal would not be taken in good faith for the reasons stated in the Order and because there is no arguable factual or legal basis for an appeal. See document for complete details. Signed by Senior Judge James A Teilborg on 1/10/19. (MSA) |
