ORDER (Service Packet): To expedite this matter, the Clerk of Court must electronically mail a copy of this Order, the First Amended Complaint #11 , and Plaintiff's Motion for Temporary Restraining Order #7 to J. Scott Conlon at sconlon@rcdmlaw.com and to Assistant Attorney General Michael Gottfried at michael.gottfried@azag.gov. Count Three, Defendants Ladele and Allen, and the individual capacity claim against Defendant Ryan are dismissed without prejudice. Defendant Ryan must answer Count One of the First Amended Complaint in his official capacity and Defendant Corizon must answer Counts Two and Four of the First Amended Complaint. Within 15 days from the filing of this Order, Defendants Ryan and Corizon must file a response(s) to Plaintiff's Motion for Temporary Restraining Order/Preliminary Injunction #7 . Plaintiff may file a reply within five days after Defendants file a response to the Motion for Temporary Restraining Order/Preliminary Injunction. Plaintiff's Application to Proceed In Forma Pauperis #2 is granted. Plaintiff's Motions for Protective Order (Docs. #4 , #10 ) are denied. The Clerk of Court must send Plaintiff this Order, and a copy of the Marshal's Process Receipt & Return form (USM-285) and Notice of Lawsuit & Request for waiver of Service of Summons form for Defendants Ryan and Corizon. Plaintiff must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. The United States Marshal will not provide service of process if Plaintiff fails to comply with this Order. If Plaintiff does not either obtain a waiver of service of the summons or complete service of the Summons, First Amended Complaint, and Motion for Temporary Restraining Order/Preliminary Injunction on a Defendant within 90 days of the filing of the Complaint or within 60 days of the filing of this Order, whichever is later, the action may be dismissed as to each Defendant not served. This matter is referred to Magistrate Judge Eileen S. Willett pursuant to Rules 72.1 and 72.2 of the Local Rules of Civil Procedure for all pretrial proceedings as authorized under 28 U.S.C. 636(b)(1). Signed by Senior Judge Susan R Bolton on 5/16/2019.
