Filing 10 CLERK'S JUDGMENT - IT IS ORDERED AND ADJUDGED that pursuant to the Court's order filed July 9, 2019, the Complaint and this action are hereby dismissed for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2). (LAD) |
Filing 9 ORDER - (1) Plaintiff's Application to Proceed In Forma Pauperis (Doc. #2 ) is granted. Plaintiff is not required to pay the filing fee for this action. (2) The Complaint (Doc. #1 ) is dismissed for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2), and the Clerk of Court must enter judgment accordingly. (3) Plaintiff's Motion to "invoke (implement) Rule 5" (Doc. #4 ), and Motion to "invoke (implement), the United States Marshall to serve summons, and complaint to Defendant(s)" (Doc. #5 ) are denied as moot. (4) The Clerk of Court is directed to place Doc. #1 -1 and Doc. #1 -2 under SEAL, as those exhibits contain social security numbers in violation of Rule 5.2 of the Federal Rules of Civil Procedure. (5) The docket shall reflect that the Court, pursuant to 28 U.S.C. 1915(a)(3) and Federal Rules of Appellate Procedure 24(a)(3)(A), has considered whether an appeal of this decision would be taken in good faith and finds Plaintiff may appeal in forma pauperis.
