ORDER: The Court lacks jurisdiction over all three counts. The Court finds that Plaintiff cannot amend his Complaint to state a cognizable claim and will thus dismiss the Complaint. See Lopez v. Smith, 203 F.3d 1122, 112730 (9th Cir. 2000) (holding that a plaintiff may amend his complaint before an action is dismissed if the defective complaint can be cured).
