ORDER - A temporary stay of removal is granted. Respondents are enjoined from removing Petitioner Priya (A201-917-305) from the United States pending further order of this Court. Petitioner's Motion for Temporary Restraining Order (Doc. #2 ) is denied. Respondents McHenry and Habich are dismissed from this case. Respondents Barr, McAleenan, and Lucero shall have 30 days from the date of service to file a Response to Petitioner's Motion for Preliminary Injunction (Doc. #2 ) in accordance with this Order. Petitioner shall have 15 days from the filing of Respondents' Response to the Motion for Preliminary Injunction to file a Reply. Respondents shall have 30 days from the date of service to answer the Petition (Doc. #1 ). The Clerk of Court shall serve: (1) a copy of the Summons, (2) the Petition (Doc. #1 ), (3) the Motion for Preliminary Injunction and/or Temporary Restraining Order (Doc. #2 ), and (4) this Order upon the United States Attorney for the District of Arizona by certified mail addressed to the civil process clerk at the office of the United States Attorney. The Clerk of Court shall also send by certified mail a copy of the Summons, the Petition, the Motion for Preliminary Injunction and/or Temporary Restraining Order, and this Order to the United States Attorney General pursuant to Rule 4(i)(1)(B) and to Respondents. (9) The Clerk of Court shall email a copy of this Order to the United State Attorney for the District of Arizona, to the attention of Diana Varela at diana.varela@usdoj.gov and to Petitioner's counsel Marshall Whitehead at marshallwhitehead@gmail.com.
