November 4, 2019 Opinion or Order Filing 5 ORDER granting #2 Plaintiff's Application to Proceed In Forma Pauperis. As required by the accompanying Order to the appropriate government agency, Plaintiff must pay the $350.00 filing fee and is assessed an initial partial filing fee of $28.28. Count One and Defendant Penzone are dismissed without prejudice. Plaintiff has 120 days from the filing date of this Order in which to discover, by subpoena or otherwise, the identity of the Unknown Officer and file a "notice of substitution" for this Defendant. The Clerk of Court must issue two subpoenas in blank and send them to Plaintiff. Plaintiff shall complete the subpoenas and promptly return them to the Clerk of Court. Upon receipt of properly completed subpoenas, the Clerk of Court must deliver the subpoenas, along with a copy of this Order, to the United States Marshal for service. The Clerk of Court may enter a judgment of dismissal for failure to prosecute without prejudice and without further notice to Plaintiff, if Plaintiff fails to file a notice of substitution within 120 days for the Unknown Officer, unless Plaintiff seeks and is granted an extension of time.
