ORDER (Service Packet): Counts Two and Four are dismissed without prejudice. Defendants Gonzales, Goddard, Clifton, and Carillo are dismissed without prejudice. Defendant Maynard must answer Counts One and Three in his individual capacity. The Clerk of Court must send Plaintiff a service packet including the First Amended Complaint #7 , this Order, and both summons and request for waiver forms for Defendant Maynard. Plaintiff must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. The United States Marshal will not provide service of process if Plaintiff fails to comply with this Order. If Plaintiff does not either obtain a waiver of service of the summons or complete service of the Summons and First Amended Complaint on Defendant within 90 days of the filing of the Complaint or within 60 days of the filing of this Order, whichever is later, the action may be dismissed. Plaintiff has 120 days from the filing date of this Order in which to discover, by subpoena or otherwise, the identity of one or more of the Doe Defendants, and to file a "notice of substitution" substituting the actual name of one or more of the Doe Defendants. The Clerk of Court must issue three subpoenas in blank and send them to Plaintiff. Plaintiff shall complete the subpoenas and promptly return them to the Clerk of Court. Upon receipt of properly completed subpoenas, the Clerk of Court must deliver the subpoenas, along with a copy of this Order, to the United States Marshal for service. The Court may dismiss without prejudice the Doe Defendants if Plaintiff fails to timely file a notice of substitution of at least one Doe Defendant, unless Plaintiff seeks and is granted an extension of time.
