Based on this finding, the Court exercises its discretion under LRCiv 5.1(a) to assign this case to the Tucson division of the District of Arizona, as Defendant requests in the Notice of Removal. IT IS THEREFORE ORDERED that the Clerk of Court shall transfer this action to the Tucson division as soon as is practicable.
