REPORT AND RECOMMENDATION - IT IS RECOMMENDED that Plaintiff's #2 application to proceed in forma pauperis be granted. Upon screening pursuant to 28 U.S.C. 1915(e)(2), IT IS FURTHER RECOMMENDED that Plaintiff's #1 complaint be dismissed without prejudice, and that Plaintiff be allowed thirty (30) days from the date the Court's order is issued to file an amended complaint, if he so chooses, although Plaintiff should be mindful of the potential defects the Magistrate Judge has identified in this Report and Recommendation.
