ORDER - Counts Two, Six, and Seven are dismissed without prejudice. Defendants Allen, Gonzalez, Saidahmad, Basset, Thompson, Pitz, Chavez, Taylor, Hamilton, Swayne, Golder, Lopez, Herrera, Mimoso, Trujillo, Cortez, and the Doe Defendants are dismissed without prejudice. The following Defendants must answer the First Amended Complaint as set forth below: a) Defendant Torres must answer the excessive force claim in Count One and the assault and battery claim in Count Five; b) Defendant Rode must answer the failure-to-protect claim in Count One and the negligence/gross negligence claim in Count Three; c) Defendants Wait and Pomeroy-Huff must answer the negligence/gross negligence claim in Count Three; d) Defendant State of Arizona must answer the negligence/gross negligence claim in Count Three and the negligent hiring, training, and supervision claim in Count Four; e) Defendant Ryan must answer the negligent hiring, training, and supervision claim in Count Four; and f) Defendant Valasquez must answer the assault and battery claim in Count Five. Plaintiff's Second Motion for Extension of Time to Serve Defendant Hamilton (Doc. #4 ) is denied as moot. Any answer or response must state the specific Defendant by name on whose behalf it is filed. This matter is referred to Magistrate Judge Eileen S. Willett pursuant to Rules 72.1 and 72.2 of the Local Rules of Civil Procedure for all pretrial proceedings as authorized under 28 U.S.C. 636(b)(1). (See document for further details).
