Filing 10 ORDER (Service Packet) - IT IS ORDERED: (1) Plaintiff's Application to Proceed In Forma Pauperis (Doc. #2 ) is granted. As required by the accompanying Order to the appropriate government agency, Plaintiff must pay the $350.00 filing fee and is assessed an initial partial filing fee of $10.81. Counts One and Three are dismissed without prejudice. Defendants Shinn; Morris; Centurion of Arizona; STG Does 1, 2, and 3; STG Garcia; Polygraph Examiner Doe; Kales, Barreras; Crabtree; Days; Smith-Whitson; Rowley; Inspector General Doe; Gay; Babich; Ortiz; Avant-Ortiz; Demery; Wishusen; Smith; Stewart; the Ellen Burno Law Firm; and the Sarah Barnes Law Firm are dismissed without prejudice. Defendants Weigel and Corizon must answer the relevant portions of Count Two. The Clerk of Court must send Plaintiff this Order, and a copy of the Marshal's Process Receipt & Return form (USM-285) and Notice of Lawsuit & Request for Waiver of Service of Summons form for Defendants. Plaintiff must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. The United States Marshal will not provide service of process if Plaintiff fails to comply with this Order. Defendants Weigel and Corizon must answer Count Two of the Complaint or otherwise respond by appropriate motion within the time provided by the applicable provisions of Rule 12(a) of the Federal Rules of Civil Procedure. Plaintiff's Motion for Temporary Restraining Order and Preliminary Injunction (Doc. #8 ) is denied in part as to Plaintiff's request for a temporary restraining order. The Court will not rule at this time on Plaintiff's request for a preliminary injunction. Within 21 days of being served with the Complaint and Motion for Temporary Restraining Order and Preliminary Injunction, Defendant Weigel must file a response to the portion of Plaintiff's Motion that seeks a preliminary injunction.
