Filing 14 ORDER: Following a hearing in December 2020, the Court set a deadline of January 8, 2021 for the parties to file a joint status report regarding whether this matter should be remanded to state court based on a lack of subject matter jurisdiction. (Doc. 11 .) On the day that deadline was set to expire, the parties filed an extension request in which they assured the Court that the meet-and-confer process was proceeding smoothly. (Doc. #12 .) Based on that representation, the Court granted the parties' request for an extension until January 22, 2021 to file the joint status report. (Doc. 13 .) That deadline expired more than a week ago and nothing has been filed. Accordingly, IT IS ORDERED that the parties shall file the joint status report by Noon on February 3, 2021. IT IS FURTHER ORDERED that the Clerk of Court shall remand this action to state court for lack of subject matter jurisdiction, without further notice, if the joint status report is not filed by Noon on February 3, 2021. Ordered by Judge Dominic W Lanza on 2/1/21. This is a TEXT ENTRY ONLY. There is no PDF document associated with this entry. (MAW) |
Filing 13 ORDER: On December 14, 2020, the Court ordered the parties to file, by January 8, 2021, a status report advising the Court that either Defendant agrees that this matter may be remanded to state court based on the absence of jurisdiction or outlining the respective positions of counsel regarding how they wish to proceed in this case. The parties have not filed such a report. Rather, the filing at Doc. 12, which is entitled "joint status report," seeks an extension of the deadline. IT IS ORDERED that the parties' "joint status report" (Doc. #12 ), which the Court construes as a motion to extend deadline, is granted. The deadline for the parties to file the status report is extended to January 22, 2021. Ordered by Judge Dominic W Lanza on 1/11/21. This is a TEXT ENTRY ONLY. There is no PDF document associated with this entry. (MAW) |
