ORDER: Plaintiff's counsel Meredith E. Marcus has filed a "motion to withdraw pro hac vice appearance." (Doc. #9 .) An "appearance" is an event; one cannot "withdraw" it. However, the motion could be construed as seeking withdrawal as counsel of record. The motion references a show cause order pending in a separate, sealed civil action pending before another judge in the District of Arizona. That show cause order does not require Ms. Marcus to withdraw as counsel of record in this action at this time, but Ms. Marcus may withdraw if she wishes to do so. However, it appears that Plaintiff will continue to be represented by another attorney at Ms. Marcus's firm, such that a motion to withdraw is unnecessary under LRCiv 83.3(b)(4). Accordingly, IT IS ORDERED that the motion to withdraw (Doc. #9 ) is denied as moot. Ms. Marcus may withdraw as counsel of record, if she so chooses, by filing a notice of substitution.
