ORDER - IT IS HEREBY ORDERED granting the parties' Stipulation (Doc. #10 ). The Internal Revenue Service is dismissed with prejudice from this action. Each party to bear its own costs and attorneys' fees. IT IS FURTHER ORDERED in light of the dismissal of Defendant Internal Revenue Service with prejudice, the pending motions (Docs. #5 , #8 , #9 ) are denied as moot. IT IS FURTHER ORDERED that this matter is remanded for lack of jurisdiction. The Clerk of the Court is directed to remand this action back to the Superior Court in and for the County of Pinal.
