ORDER: Before the Court is Plaintiff's Motion to Stay and Modify the Order Setting Rule 16 Scheduling Conference (Doc. #15 ). Plaintiff states that all named Defendants have suggested they may default, rendering moot the need for a Rule 26(f) conference between the parties. The deadline for an answer or response has not yet passed, however. The Court will reset the Rule 16 Schedule Conference (and thus the Rule 26(f) conference) to a later date. If Defendants fail to answer or otherwise respond to Plaintiff's Complaint, Plaintiff shall seek entry of default from the Clerk of Court and vacation of the Scheduling Conference from the Court. Accordingly, IT IS ORDERED that Plaintiff's Motion (Doc. #15 ) is granted, as stated herein. The Rule 16 Scheduling Order set for December 21, 2021 (Doc. #13 ) is vacated and reset to January 25, 2022, at 10:00 a.m. The remainder of the Order setting Scheduling Conference (Doc. #13 ) is otherwise affirmed.
