Filing 8 AMENDED COMPLAINT against Susan Hall, Pampered Pets & Plants Incorporated filed by Sandra S Hoppmann. (Kingsley, Pamela) |
Filing 7 ORDER: The parties have filed a stipulation to extend the time for Plaintiff to amend her complaint, for Defendants to respond to the anticipated amended complaint, and to clarify that Defendants need not respond to the current complaint. (Doc. #6 .) The first part of this request is unnecessary - as set out in the preliminary order, "if all parties consent to an amendment [of a pleading], leave of the Court is not necessary, so the parties shall not file a motion or stipulation." (Doc. #5 at 2.) Additionally, even though it appears likely that Plaintiff will end up amending her complaint with Defendants' consent, a deadline must remain for Defendants to respond to the current iteration of the complaint just in case Plaintiff ends up choosing not to amend. Accordingly, IT IS ORDERED that the parties' stipulation is granted in part. (Doc. #6 .) The deadline for Defendants to respond to Plaintiff's current complaint is extended to April 15, 2022. Should Plaintiff choose, before then, to amend her complaint with Defendants' consent, Plaintiff must follow the procedures set forth in LRCiv 15.1 and pp. 2-3 of the preliminary order.
