September 6, 2022 Opinion or Order Filing 5 ORDER: Within 30 days of the date this Order is filed, Petitioner must file a completed and signed Certificate, using the Certificate form provided with this Order, certifying that Petitioner's signature on the Certificate will serve as an original signature, under penalty of perjury, on his 2254 Petition for purposes of 28 U.S.C. 2242, Rule 2(c)(5) of the Rules Governing Section 2254 Cases, Rule 3.5(a) of the Local Rules of Civil Procedure, and Rule 11 of the Federal Rules of Civil Procedure. If Petitioner fails to file a completed and signed Certificate on the form provided with this Order within 30 days, the Clerk of Court must, without further notice, strike Petitioner's 2254 Petition and enter a judgment of dismissal of this action without prejudice and without further notice to Petitioner. Petitioner's Application to Proceed In Forma Pauperis (Doc. #2 ) is denied without prejudice. Within 30 days of the date this Order is filed, Petitioner must either pay the $5.00 filing fee or file a complete Application to Proceed In Forma Pauperis. If Petitioner fails to either pay the $5.00 filing fee or file a complete Application to Proceed In Forma Pauperis within 30 days, the Clerk of Court must enter a judgment of dismissal of this action without prejudice and without further notice to Petitioner and deny any pending unrelated motions as moot. The Clerk of Court must mail Petitioner a court-approved form for filing an Application to Proceed In Forma Pauperis (Habeas) and a Certificate form. (See Order for full details.)
