Moore shall pay the remaining civil penalty balance of $88,248 with additional interest pursuant to 31 U.S.C. 3717, until the entry of Judgment, together with post-judgment interest pursuant to 28 U.S.C. 1961 from the date of the entry of this Judgment. The hearing set in this matter on 7/18/22 is cancelled. The Court shall retain jurisdiction of this matter for the purposes of enforcing the terms of this Judgment. ORDER - Upon the Application (Doc. #1 ) of the Securities and Exchange Commission, IT IS HEREBY ORDERED that the above-captioned Respondent Michael G. Moore shall appear before this Court in Courtroom 505 of the Sandra Day O'Connor U.S. Courthouse located at 401 W. Washington Street, Phoenix Arizona on July 25, 2022 at 9:00 AM and show cause why the final Commission Order requiring Moore to pay a civil penalty of $88,248 with additional interest pursuant to 31 U.S.C. 3717, and imposing injunctive relief, should not be granted. IT IS FURTHER ORDERED that Petitioner shall serve Respondent pursuant to Rule 4 of the Federal Rules of Civil Procedure with both the Application (Doc. #1 ), the Declaration (Doc. #2 ), and this Order by June 8, 2022. Petitioner shall file proof of service on the docket. IT IS FURTHER ORDERED that Respondent shall file a Notice of Appearance and serve and file any opposing papers by June 22, 2022. IT IS FURTHER ORDERED that if Respondent fails to file opposing papers and/or appear at the scheduled hearing, the Court may find Respondent in default and enter an appropriate Order against such party at such time without further notice being given.
