Filing 14 ORDER - The Motion (Doc. #12 ) is granted. The Clerk shall send Plaintiff a service packet which includes: this Order, the Complaint (Doc. #1 ), and both summons and request for waiver of service forms for Defendant. Plaintiff must complete and return the service packet(s) to the Clerk no later than 6/2/23. Upon receipt, the Clerk shall forward the service packets to the United States Marshals Service. The USMS shall notify Defendant of the commencement of this action and request waiver of service of the summons and Complaint pursuant to Rule 4(d) of the Federal Rules of Civil Procedure. The USMS shall file with the Clerk of Court, as soon as they are received. If a waiver of service of summons is not returned by Defendant within 21 days of the date the request for waiver was sent, the USMS shall personally serve copies of Complaint and summons for Defendant. Plaintiff is advised that service of process will not be provided if he/she fails to comply with this Order; and if Plaintiff does not obtain a waiver of service or complete service on Defendant by 7/3/23, this action will be for failure to serve pursuant to Rule 4(m) of the Federal Rules of Civil Procedure.
