Filing 6 ORDER (Service Packet): Plaintiff's Motion for Correction of Record #5 is granted. The Clerk of Court must update the docket to reflect Plaintiff's inmate number as "051089." Within 30 days of the date this Order is filed, Plaintiff must either pay the $350.00 filing fee and $52.00 administrative fee or file a complete Application to Proceed In Forma Pauperis and a certified six-month trust account statement (or institutional equivalent). If Plaintiff fails to either pay the $350.00 filing fee and $52.00 administrative fee or file a complete Application to Proceed In Forma Pauperis within 30 days, the Clerk of Court must enter a judgment of dismissal of this action without prejudice and without further notice to Plaintiff and deny any pending unrelated motions as moot. Defendants Thomas, Adams, and Stewart must answer Counts One, Two, and Three, respectively, in their individual capacities only; Defendant NaphCare must answer Count Four; and Defendants Thornell and Hobbs must answer Counts Five and Six, respectively, in their official capacities only. Plaintiff's Motion for Preliminary Injunction and Temporary Restraining Order #2 is denied in part as to his request for a temporary restraining order. The Court will not rule at this time on Plaintiff's request for a preliminary injunction. Within 15 days of service, Defendants NaphCare, Thornell, and Hobbs must file a response to the portion of Plaintiff's Motion for Emergency Preliminary Injunction and Temporary Restraining Order seeking a preliminary injunction. Plaintiff may file a reply within 10 days of Defendants' response. The Clerk of Court must prepare a service packet including copies of the Summons, Complaint, Motion for Preliminary Injunction and Temporary Restraining Order, and this Order and forward it to the United States Marshal Service for personal service on Defendants NaphCare, Thornell, and Hobbs. The Clerk of Court must send Plaintiff this Order, and a copy of the Marshals Process Receipt & Return form (USM-285) and Notice of Lawsuit & Request for Waiver of Service of Summons form for Defendants Thomas, Adams, and Stewart. The Clerk of Court must send Plaintiff this Order, and a copy of the Marshals Process Receipt & Return form (USM-285) and Notice of Lawsuit & Request for Waiver of Service of Summons form for Defendants Thomas, Adams, and Stewart. Plaintiff must complete and return the service packet to the Clerk of Court within 21 days of the date of filing of this Order. The United States Marshal will not provide service of process if Plaintiff fails to comply with this Order. If Plaintiff does not either obtain a waiver of service of the summons or complete service of the Summons and Complaint on a Defendant within 90 days of the filing of the Complaint or within 60 days of the filing of this Order, whichever is later, the action may be dismissed as to each Defendant not served. Except with respect to (1) Plaintiff's Motion for Preliminary Injunction and Temporary Restraining Order and (2) the issue regarding the fees and in forma pauperis status, this matter is referred to Magistrate Judge James F. Metcalf pursuant to Rules 72.1 and 72.2 of the Local Rules of Civil Procedure for all pretrial proceedings as authorized under 28 U.S.C. 636(b)(1).
