ORDER denying without prejudice Plaintiff's Application to Proceed in District Court Without Prepaying Fees or Costs (Doc. #2 ). Plaintiff shall have twenty-one (21) days from the date this Order is signed to pay the applicable filing fee or to submit an amended application to proceed in district court without prepaying fees or costs. Any amended application must include the civil case number used in this Order, No. CV-23-02323-PHX-DMF. FURTHER ORDERED that if Plaintiff elects to file an amended complaint, the amended complaint must be filed no later than twenty-eight (28) days from the date this Order is signed. FURTHER ORDERED that if Plaintiff elects to file an amended complaint, the amended complaint may not be served until and unless the filing fee is paid or the Court screens the amended complaint pursuant to 18 U.S.C. 1915(e)(2) and orders that the amended complaint proceed to service. FURTHER ORDERED informing that the failure to timely prosecute this matter or failure to comply with this Order, other Orders of this Court, or applicable rules may result in the dismissal of this action.
