ORDER: Plaintiff's Complaint (Doc. 1-3 at 6-9) is dismissed for failure to comply with Rule 8(a) of the Federal Rules of Civil Procedure. Plaintiff has 30 days from the date this Order is filed to file a first amended complaint in compliance with this Order. If Plaintiff fails to file an amended complaint within 30 days, the Clerk of Court must, without further notice, enter a judgment of dismissal of this action without prejudice and deny any pending unrelated motions as moot. Maricopa County Sheriff Russell Skinner's Notice of Automatic Substitution (Doc. #4 ) is granted to the extent he is requesting the Court direct the Clerk of Court to substitute him for Defendant Penzone in his official capacity. Pursuant to Rule 25(d) of the Federal Rules of Civil Procedure, Maricopa County Sheriff Russell Skinner is substituted for Defendant Paul Penzone in his official capacity only. Defendant Penzone shall remain as a Defendant in this action in his individual capacity. Defendants Mitchell, Penzone, and Skinner's Motion to Dismiss (Doc. #5 ) is denied as moot. Defendant Sullivan's Motion to Dismiss (Doc. #6 ) is denied as moot. Plaintiff's "Motion to Deny Defendants' Motions to Dismiss and Removal" (Doc. #9 ) is denied. The Clerk of Court must mail Plaintiff a court-approved form for filing a civil rights complaint by a prisoner. Signed by Judge Susan M Brnovich on 4/1/2024. (KJ)
