Filing 80 ORDER AND OPINION that plaintiffs' 54 motion for partial summary judgment is GRANTED insofar as it seeks a ruling that Etsitty was acting within the scope of his employment at the time of the collision and that the United States is liable for his conduct; that defendant's 44 motion for summary judgment is GRANTED IN PART and DENIED IN PART as follows: 1) defendant's motion is GRANTED as to plaintiffs' negligent hiring, training, supervision, retention, and entrustment claims, and they are DISMISSED, and 2) defendant's motion is DENIED as to plaintiffs' negligence, negligence per se, and loss of consortium claims.
