ORDER that dft Mohave State Bank's 15 Motion to Dismiss First Amendment Complaint is granted in part and denied in part. The motion is granted to the extent that the breach of fiduciary duty claim, the Seventh Cause of Action of the First Amend ed Complaint, is dismissed with prejudice as a matter of law pursuant to Fed.R.Civ.P. 12(b)(6), and it is denied in all other respects; the parties shall file their Joint Case Management Report no later than May 24, 2010; that the Scheduling Conference shall be held on Monday, June 7, 2010, at 11:00 a.m. in Courtroom 601.
