ORDER AND OPINION granting in part and denying in part 6 Defendant's Motion to Dismiss. It is GRANTED insofar as plaintiff's claim for negligent infliction of emotional distress (labeled "reckless" infliction of emotional distress in the complaint) is DISMISSED.
