ORDER - IS HEREBY ORDERED that Pearson's Motion to Dismiss Count II of the Complaint (Doc. 20) is denied with respect to the request to dismiss this action with prejudice and granted with respect to the request to compel arbitration. IT IS FUR THER ORDERED that the parties are directed to arbitration of DRK's fraud claims in accordance with the terms of the parties arbitration agreement. IT IS FURTHER ORDERED that this action is stayed pending the outcome of arbitration pursuant to 9 U.S.C. § 3 and further order of this Court.
